TFC Hardware Terms of Service

1. Overview

These Terms of Service apply to your use of the TFC Hardware website and to purchases made through our online store.

TFC Hardware is operated by FUN CLUB PTY LTD (ABN 61 673 405 706).

Throughout these Terms, “TFC Hardware”, “we”, “us” and “our” refer to FUN CLUB PTY LTD. “You” and “your” refer to any visitor, customer or person using the website.

By accessing our website, creating an account or placing an order, you agree to these Terms of Service, together with our Shipping Policy, Returns & Refunds Policy and Privacy Policy.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

2. Eligibility

You must be legally capable of entering into a binding agreement to place an order.

If you are under 18 years of age, you may only use this website and place an order with the involvement and permission of a parent or legal guardian.

You are responsible for ensuring that the information provided when placing an order is complete and accurate.

3. Products and Product Information

We aim to provide accurate product descriptions, specifications, dimensions, photographs and compatibility information.

Because screens and devices display colours differently, the appearance of a product may vary slightly from the images shown online. Minor variations in colour, finish, packaging or appearance that do not affect the product’s intended function may also occur.

Product photographs may include props, tools or accessories that are not included. The product description and selected variant determine what is included in your purchase.

4. Product Compatibility and Installation

Many products sold by TFC Hardware are intended for 3D printers, 3D-printed components, workshop projects, repairs or custom assemblies.

Before ordering, you are responsible for checking the relevant measurements, thread size, material, quantity, model and compatibility information against the requirements of your project.

Product information provided on our website is general information and is not professional engineering, electrical or safety advice.

Products must be installed and used correctly with suitable tools, protective equipment and adult supervision where appropriate. Small hardware components may present a choking hazard and should be kept away from children.

Nothing in this section limits your rights where a product is faulty, unsafe, incorrectly supplied or does not match its description.

5. Orders

Placing an order is an offer to purchase the selected products under these Terms.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been accepted.

An order is accepted when we confirm that it has been dispatched.

Before dispatch, we may contact you or cancel an order where there is a genuine reason, including:

  • the product is unavailable;

  • the product, price or description contains an obvious error;

  • payment cannot be authorised;

  • the delivery address is incomplete, invalid or outside Australia;

  • the order appears to be fraudulent or unauthorised; or

  • we are unable to fulfil the order legally or safely.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled products and any applicable shipping charges.

6. Prices and Payment

All prices are displayed in Australian dollars unless otherwise stated.

Applicable taxes, shipping charges and discounts will be shown at checkout before you submit your order.

We may update prices and promotions from time to time. A price change will not affect an order that has already been accepted.

Payment must be successfully authorised before an order is processed. Available payment methods are displayed at checkout and may be provided by third-party payment processors.

You must not use a payment method without the account holder’s permission.

7. Product Availability

Products are subject to availability.

Adding a product to your cart does not reserve it. If an item becomes unavailable after you place an order, we will contact you and offer an appropriate solution, such as:

  • a refund for the unavailable item;

  • cancellation and refund of the affected order; or

  • another option agreed with you.

We will not substitute a materially different product without your agreement.

8. Shipping

We currently ship only to addresses within Australia.

Orders are dispatched from Sydney, NSW within 2 business days after payment has been confirmed, subject to the circumstances described in our Shipping Policy.

Delivery dates are estimates and may be affected by the destination, public holidays, peak periods, severe weather or Australia Post network disruptions.

9. Returns, Refunds and Consumer Guarantees

Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a repair, replacement, refund, compensation or another remedy if a product:

  • is faulty or unsafe;

  • is not of acceptable quality;

  • does not match its description;

  • is not fit for a disclosed purpose; or

  • is incorrectly supplied.

Any conditions applying to change-of-mind returns do not limit your rights where a product fails to meet a consumer guarantee.

10. Order Changes and Cancellations

If you need to change or cancel an order, please contact us as soon as possible.

We will try to accommodate your request, but changes or cancellations cannot be guaranteed once an order has been packed or dispatched.

If the order has already been dispatched, it may need to be handled under our Returns & Refunds Policy.

11. Website Accounts

If you create an account, you are responsible for:

  • keeping your login details confidential;

  • providing accurate and current information; and

  • notifying us if you believe your account has been accessed without permission.

We may suspend access to an account where reasonably necessary to protect the customer, the website or our business from suspected fraud, misuse or security threats.

12. Acceptable Use

You must not use this website:

  • for unlawful, fraudulent or misleading purposes;

  • to interfere with the website’s operation or security;

  • to introduce viruses, malicious code or harmful technology;

  • to collect information about other users without permission;

  • to submit false orders or payment information; or

  • to infringe the intellectual property, privacy or other legal rights of another person.

Unless otherwise stated, the website and its content—including text, photographs, graphics, branding, logos and page designs—are owned by or licensed to FUN CLUB PTY LTD.

You may access and use the website for personal shopping and other lawful, non-commercial purposes.

Product names and trademarks belonging to other companies remain the property of their respective owners.

If you submit a review, photograph, comment or other content, you confirm that:

  • the content is based on your genuine experience;

  • it is accurate to the best of your knowledge;

  • you have permission to submit it; and

  • it does not contain unlawful, abusive, misleading or infringing material.

You retain ownership of your content but give FUN CLUB PTY LTD permission to display and reproduce it in connection with TFC Hardware, our store and our products.

We may decline or remove submitted content where reasonably necessary, including content that is unlawful, misleading, abusive, unrelated, fraudulent or infringes another person’s rights.

15. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment processors, Australia Post and other service providers.

Third-party services may have their own terms and privacy practices. We are not responsible for the content of an unrelated third-party website merely because our website links to it.

This section does not limit any responsibility we have for service providers acting on our behalf where that responsibility cannot lawfully be excluded.

16. Website Availability

We aim to keep the website accurate, secure and available, but we cannot guarantee uninterrupted or error-free access.

We may temporarily restrict access where reasonably necessary for maintenance, security, updates or circumstances outside our reasonable control.

If a website error affects an order or payment, please contact us so we can investigate and provide an appropriate solution.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

To the extent permitted by law, FUN CLUB PTY LTD is not responsible for indirect or consequential loss that was not reasonably foreseeable and was not caused by our failure to comply with an applicable legal obligation.

You remain responsible for selecting products that match your disclosed project requirements and for installing and using products safely and correctly.

This section does not exclude liability where doing so would be unlawful.

18. Privacy

We collect, use and protect personal information in accordance with our Privacy Policy and applicable Australian privacy laws.

Information provided during checkout may be shared with service providers where necessary to process payments, fulfil orders, deliver parcels, prevent fraud and operate the website.

19. Changes to These Terms

We may update these Terms to reflect changes to our products, services, website or legal obligations.

Updated Terms will be posted on this website with the date of the latest revision.

Changes will not retrospectively alter the terms applying to an order that was already accepted, unless required by law or agreed with you.

20. Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be interpreted or removed only to the extent necessary. The remaining Terms will continue to apply.

21. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You and FUN CLUB PTY LTD submit to the courts and tribunals that have jurisdiction in New South Wales, subject to any rights you may have under applicable consumer law.
